Terms of Service

1. Acceptance & Who We Are

These Terms of Service ("Terms") govern your use of:

• the website mybluetunes.com, and
• the Android app Blues Radio - My Blue Tunes available on Google Play,

together the "Service". The Service is operated by App Design Lab 2025, an independent developer based in Greece ("we", "us", "our"). Contact: info@mybluetunes.com.

Our Privacy Policy explains how we handle personal data and forms part of these Terms. If you downloaded the App from Google Play, the Google Play Terms of Service also apply to your use of Google Play.

2. Service Description

My Blue Tunes brings together blues radio stations from around the world. The Service includes:

• Radio streaming: access to blues radio stations through third-party streams
• Station discovery: browse stations by category, country, popularity and search
• Now Playing: live song information and album artwork where available
• Account features (App, optional): favourites, ratings and station suggestions
• Educational content (Website): articles about blues history, artists and styles

The Service is free to use and supported by advertising. An optional one-time purchase removes ads in the App (see section 10). We may change, suspend or discontinue features or stations at any time; where a change significantly affects a purchase you made, section 10 applies.

3. Eligibility

You may listen without an account. To create an account you must be at least 13 years old, or the minimum age of digital consent in your country if that is higher (for example 15 in Greece or 16 in Germany). If you are under 18, you should review these Terms with a parent or legal guardian.

4. User Accounts

• Accounts are optional. You can register with your email address or sign in with Google.
• Keep your details accurate and your password secure. You are responsible for activity under your account.
• Tell us at info@mybluetunes.com if you believe your account has been used without your permission.
• You can delete your account at any time from Profile > Delete Account in the App. The Privacy Policy explains what is deleted.

5. Acceptable Use

The Service is for your personal, non-commercial listening. You agree not to:

• record, copy, redistribute, rebroadcast or publicly perform radio streams accessed through the Service
• break any law or infringe the intellectual property or other rights of others
• try to gain unauthorised access to the Service, our servers, other accounts or networks
• interfere with, overload or disrupt the Service, or bypass its security or advertising features (other than through the "Remove ads" purchase)
• use robots, scrapers or other automated means to access the Service or extract its station list without our written permission
• upload viruses or other harmful code
• collect personal information about other users
• impersonate us or any other person, or send spam

6. User Submissions

When you send us station suggestions, images, ratings, reports or feedback, you confirm that they are accurate, that you have the right to share them, and that they are not unlawful, offensive or harmful.

You keep ownership of your submissions. You give us a worldwide, non-exclusive, royalty-free licence to use, reproduce, adapt and display them for the purpose of operating and improving the Service, for as long as they are used in the Service. We may decline or remove any submission.

7. Intellectual Property

The Service's software, design, texts and the "My Blue Tunes" name and logo belong to us or our licensors and are protected by copyright and trademark law. Radio broadcasts, station names and logos, song information and album artwork belong to their respective owners.

We grant you a personal, non-exclusive, non-transferable and revocable licence to use the Service in accordance with these Terms. You may not copy, modify, reverse-engineer, resell or create derivative works from the Service, except where the law allows it.

8. Radio Streams & Third-Party Content

8.1 Radio streams

We do not own, operate or control the radio stations available in the Service. Each station is responsible for its own broadcasts, including content, audio advertising and music licensing. We do not guarantee that any station will be available, uninterrupted or of a certain quality, and stations may be added or removed at any time.

8.2 Requests from stations and rights holders

If you operate a station or hold rights in content available through the Service and want a station, logo or other item removed or corrected, write to info@mybluetunes.com with the station name and details of your request. We review requests promptly and remove content where appropriate.

8.3 External links

The Service may link to websites or apps we do not control. We are not responsible for their content or privacy practices.

9. Advertising

The Service shows advertising, provided by Google AdSense on the Website and by Google AdMob in the App, as described in our Privacy Policy. Personalised ads are shown in the EEA, the UK and Switzerland only with your consent.

Advertisers are responsible for their ads and for the products and services they offer. Any dealings you have with an advertiser are between you and that advertiser.

10. In-App Purchase: Remove Ads

• What it is: an optional one-time purchase in the App. It is not a subscription and does not renew.
• What it removes: the banner, native, full-screen and app-open ads shown by the App. It does not remove audio advertising that radio stations include in their own broadcasts.
• Price and payment: the price is shown in the App before you buy. Payment is processed by Google Play under its terms.
• Your Google account: the purchase is linked to the Google account used to buy it. It does not require a My Blue Tunes account. After reinstalling, or on another device with the same Google account, use Remove ads > Restore purchase.
• Refunds: refunds are handled under the Google Play refund policy. If a purchase is refunded, ads are shown again.
• Discontinuation: if we stop offering the App, your purchase applies for as long as the App remains installed and working.
• Consumer rights: nothing in these Terms limits your statutory rights as a consumer.

11. Disclaimers

We work to keep the Service running well, but we do not promise that it will be uninterrupted, error-free or free of harmful components, or that song information and artwork will always be accurate. Stream availability depends on third-party stations and factors outside our control.

12. Limitation of Liability

To the extent permitted by law, we are not liable for indirect or consequential losses, loss of data, profits or goodwill, or for damage caused by third-party content, radio streams or advertisers.

To the extent permitted by law, our total liability to you for all claims related to the Service is limited to the amount you paid us in the twelve (12) months before the claim.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for intentional misconduct or gross negligence, or any other liability that cannot be excluded or limited under applicable law, including your rights as a consumer.

13. Suspension & Termination

You can stop using the Service and delete your account at any time. We may suspend or close an account, or refuse submissions, if these Terms are seriously or repeatedly broken, or where needed to protect users, the Service or third parties. Where possible we will tell you why. Suspending your account does not affect a "Remove ads" purchase linked to your Google account.

14. Changes to These Terms

We may update these Terms when the Service or the law changes. We will update the "Last Updated" date above and, for significant changes, show a notice on the Website or in the App before they take effect. If you continue to use the Service after the changes take effect, the updated Terms apply. If you do not agree, you can stop using the Service and delete your account.

15. Governing Law & Other Terms

15.1 Governing law

These Terms are governed by the laws of Greece. If you are a consumer living in another country, you also keep the protection of the mandatory laws of that country, and you may bring a claim in the courts of your country of residence.

15.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions stay in effect.

15.3 Entire agreement

These Terms and the Privacy Policy are the entire agreement between you and us about the Service.

15.4 No waiver

If we do not enforce a provision, this does not mean we have waived our right to do so later.

15.5 Transfer

You may not transfer your rights under these Terms. We may transfer our rights and obligations to another party that takes over the Service, provided your rights under these Terms are not reduced.
